This document was developed by representatives of the sponsoring organizations. "These organizations represent sectors which play central roles within higher education in the creation, use, and management of copyrighted works. The principal objective of this project was to bring together these groups, which have differing perspectives and often conflicting views on the appropriate use of copyrighted works, to produce a document that conveys their common understanding regarding the basic meaning and practical significance of copyright for the higher education community." Part I is copyright basics. Part II discusses insitutional policy issues for colleges and universities.

The Digital Learning Challenge: Obstacles to Educational Uses of Copyrighted Material in the Digital Age

"This foundational white paper reports on a year-long study by the Berkman Center for Internet and Society [at Harvard Law School], funded by a grant from the Andrew W. Mellon Foundation, examining the relationship between copyright law and education. In particular, we wanted to explore whether innovative educational uses of digital technology were hampered by the restrictions of copyright. We found that provisions of copyright law concerning the educational use of copyrighted material, as well as the business and institutional structures shaped by that law, are among the most important obstacles to realizing the potential of digital technology in education." Report on Copyright and Digital Distance Education

This report summarizes the results of a study of the copyright issues involved in digital distance education conducted by the Copyright Office in 1999, prior to the passing of the TEACH Act. Somewhat dated, but a useful review.

Section 108 Study Group
This select committee of copyright experts was convened by the Librarian of Congress and charged with updating the Copyright Act for the digital world. Section 108 provides libraries and archives specific exceptions for purposes of preservation and replacement. The group's report contains recommendations on how to revise copyright law while maintaining the balance between the rights of creators and copyright owners and the needs of libraries and archives.
